CLEARWATER BEACH FAMILY FUN FESTIVAL RELEASE AND HOLD HARMLESS AGREEMENT
The undersigned, being over the age of eighteen (18) years, does hereby request Tampa Bay Harvest, Inc., Clearwater Beach Association and City of Clearwater for permission to participate in the Clearwater Beach Family Fun Festival.
I understand the benefit of this event, and I agree to obey all instructions, orders, commands given me by the officials in charge of the event. I acknowledge the risks of participation in this event and I may be subject to physical injury or property damage, whether caused by an intentional or unintentional act or omission. In full consideration and acknowledgement of the risks of participation in this event, I freely and voluntarily agree to participate in this program/event and accept the risks of so doing. In consideration of being allowed to participate in this voluntary program/event and receiving the benefit thereof, I, myself, my heirs, personal representative, next of kin or assigns, do hereby forever release, waive, discharge, hold harmless and covenant not to sue Tampa Bay Harvest, Inc., Clearwater Beach Association and the City of Clearwater, its officials, officers, agents, employees, representative, assigns, and insurers, individually and collectively, hereinafter referred to as “releasees”, of and from all liability for any and all loss or damage, including personal injury, property damage or death, whether caused by the negligence of the release's or otherwise, while I am in any way participating in the above described program/event. I further acknowledge that I have read and fully understand this release and hold harmless agreement, and that I have voluntarily executed the same without any further inducement or promise not contained herein. I expressly agree that this agreement shall be construed as broadly as permitted by the law of the State of Florida, and that if any part hereof is declared invalid, the remainder shall remain in full force and effect.

EXHIBITOR RULES AND REGULATIONS
 
The staff at TAMPA BAY HARVEST, INC., CLEARWATER BEACH ASSOCIATION and THE CITY OF CLEARWATER would like to thank you for your participation in the Second Annual CLEARWATER BEACH FAMILY FUN FEST.
In order for you to help us make our festival the best it can be, we have established some rules and regulations. To participate in our festival, you MUST observe the following....
 
All categories shall be reviewed, juried and screened prior to your acceptance. Any media NOT approved during the application process that appears in your both at an event will be removed.
 

The Vendor fee (checks only) must be paid with the application submittal. If not accepted into the festival, your vendor fee will be returned to you un-cashed.

Displays must be professional and aesthetically pleasing. The goal is to make your tent look like a “Mini” art gallery.
 
The following items are prohibited for sale at Clearwater Beach Family Fun Festival: Fire Arms, Alcohol, Obscene Merchandise, and Illegal paraphernalia.
The Clearwater Family Fun Festival will be the sole arbitrator of what material can be sold.
 
Exhibitors will leave their exhibit space clean after packing up at break down. If your space is not clean after the festival, this could result in expulsion from future festivals.
 
If available, please send a biography of you and your work. We like to have these on file for publicity opportunities.
 
Food and Entertainment Vendors for street events must provide the proper licenses and proof of insurance, naming Tampa Bay Harvest Inc., Clearwater Beach Association and the City of Clearwater as additional insured.
 
Cooperation with local authorities is mandatory.
 
CANCELLATIONS – THERE ARE NO REFUNDS FOR A CANCELLED FESTIVAL! THERE ARE NO REFUNDS FOR VENDOR CANCELLATIONS and all vendor cancellations MUST be in writing, either by mail, fax or email.
 
The approved exhibitor will occupy his or her booth at all times. NO subletting or sharing of space is permitted. PETS ARE NOT ALLOWED AT FESTIVAL.
 
TAXES – Each exhibitor is responsible for collecting the State Sales Tax and filing a report with the local Department of Revenue.
 
An accepted application is a commitment to display your work during ALL scheduled hours of the show.
 
Bank Fees – A $25 bank fee will be charged on all return checks. The check amount plus the $25 fee is payable with a money order, cashier’s check or cash.
 
TENTS – Exhibitors are responsible for making their tents sturdy against wind, rain etc. Tents MUST be manufactured of flame – retardant materials. Staking into the pavement will NOT be permitted. Tampa Bay Harvest, Clearwater Beach Association and the City of Clearwater are not responsible for lost, damaged or stolen property. Dollies are recommended for vendor set-up and breakdown.
 
Exhibitors will receive an ample amount of booth space. Exhibitors will NOT take up any additional space without first consulting with a show coordinator. ALL WORK, DISPLAY and STORAGE WILL NOT GO BEYOND THE ASSIGNED EXHIBITOR SPACE. A space larger than 10X10 will require the vendor applicant to obtain a building permit from the City of Clearwater prior to the festival.
 
Electricity, if needed, will be provided for vendor spaces at a cost of $10.00. A 100 foot extension cord is recommended. A power strip and duct tape may also be helpful. No generators will be permitted.
 
The exhibitor’s space shall be occupied by 7:30am the morning of the show or you will be considered a “no-show” and your space will be given away with no possible refund or credit. Vehicles MUST be removed from the show area by 8:30am unless otherwise specified. Please note that Friday night setup will also be allowed. Security will be provided by the festival for the entire event.
 
Designated Vendor Parking areas are not supplied. We highly recommend you arrive early, unload, park, and then set up your booth.
 
Set-Up and Breakdown times will be strictly enforced. Please see show confirmation for details.
 
Management reserves the right to make final interpretations of all rules and regulations. Please read the general release on front of application before signing!
